1. Who we are
These terms are offered by KAMTOBE Creations Limited (“Kamtobe”, “we”, “us”), a company registered in England and Wales, company number 17288786. Registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Email admin@kamtobecreations.com. WhatsApp (messages and WhatsApp calls): +44 7352 302982.
We are a UK-registered creative studio that works remotely with clients anywhere. These terms cover the brand, design, film, music, website, systems, social content and coaching work we agree with you.
2. Consumer or business client
Some parts of these terms depend on who you are:
- Consumer: you are an individual buying for yourself, not for your trade, business, craft or profession. For example, someone ordering a personal song or a portrait for a family occasion. Part A applies to you.
- Business client: you are buying for a business, organisation or profession, including as a sole trader. Part B applies to you.
Sections 3 to 7 apply to everyone.
3. Your proposal and our agreement
Every project starts with a written proposal or scope confirmation. Before you agree, it tells you what we will make, the total price including any taxes, how and when you pay, the expected timeline, the number of revision rounds and the formats you will receive. For consumers it also explains your right to cancel. Our agreement starts when you confirm the proposal in writing. If the proposal and these terms say different things, the proposal applies, except where the law gives you rights that cannot be removed.
4. Prices and payment
- Prices are as stated in your proposal, in the currency it shows.
- Payments are made through Stripe’s secure checkout, or another method we confirm in writing. Please only use a payment link after we have confirmed your scope and price in writing.
- Deposit: 50% of the price, payable when you confirm the proposal. The balance is due as set out in your proposal.
- If a deposit or other payment is made and the contract is then cancelled, the refund rules in Part A (consumers) or Part B (business clients) apply. A deposit is never kept in full simply because it is called a deposit.
5. What we need from you
Please send the materials, information, feedback and approvals the project needs. You confirm that you have the right to use anything you send us, such as logos, images, text, recordings and footage. If input arrives late, the timeline moves with it, and we will tell you the new dates.
6. Revisions and changes
Your proposal states how many revision rounds are included. A round is one set of consolidated feedback on a piece of work. Further rounds, or changes to the agreed scope, are quoted first and go ahead only when you agree in writing.
7. Using our work in our portfolio
We would like to show finished work in our portfolio. We will ask you first, and we will not show work you ask us to keep private, or work that is confidential or personal to you.
Part A. Consumers
A1. Your right to cancel (14 days)
Where we agree the contract with you at a distance (for example by email, chat, phone or online, without meeting in person), you have the right to cancel within 14 days without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The cancellation period ends 14 days after the day the contract is entered into.
To cancel, tell us clearly before the period ends, for example by emailing admin@kamtobecreations.com or writing to our registered office. You can use the model cancellation form below, but you do not have to. It is enough to send your message before the 14 days end.
A2. If you want us to start within the 14 days
We will only start work during the cancellation period if you expressly ask us to, in writing, and confirm that you understand the following:
- If you cancel after we have started at your request, you pay an amount in proportion to the work done up to the time you tell us you are cancelling, compared with the full service.
- Once the service has been fully performed at your request, you lose the right to cancel.
- If we supply finished digital content that is not on a physical medium (for example an audio or video file) during the cancellation period at your express request, you lose the right to cancel from the moment supply begins, once you have acknowledged this.
If you do not ask us to start early, we will begin after the 14 days have passed.
A3. Refunds when you cancel
We will refund all payments you have made under the contract, including any deposit, less any proportionate amount for work done at your request under A2. We will make the refund without undue delay and no later than 14 days after the day you tell us you are cancelling. We refund using the same payment method you used, unless you expressly agree otherwise, and you will not pay any fee for the refund.
A4. Your other legal rights
Under the Consumer Rights Act 2015 we must carry out the service with reasonable care and skill, and as described in your proposal. If we do not, you can ask us to put it right, and if we cannot, you may be entitled to a price reduction. Nothing in these terms affects your statutory rights. For more information, contact Citizens Advice.
A5. Using what we make for you
Once you have paid in full, you may use the final deliverables for the personal purposes described in your proposal. Ownership of the copyright in the final deliverables passes to you once you have paid in full, and we may show the work in our portfolio.
A6. Coaching sessions
To rearrange a coaching session, please email us at least 24 hours before it starts.
Model cancellation form
Complete and return this form only if you wish to cancel the contract.
Part B. Business clients
The consumer cancellation rights in Part A do not apply to business clients.
B1. Payment
If a payment is late, we may pause work until it is paid. Statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998 may apply.
B2. Approving deliveries
Please review each delivery and tell us if anything does not match what we agreed. If we do not hear from you within 10 working days of a delivery, that delivery counts as approved.
B3. Ownership of the work
Ownership of the copyright in the final deliverables passes to you once you have paid in full, and we may show the work in our portfolio. We keep ownership of our own tools, templates, code libraries, methods and know-how, and of drafts and concepts you did not choose. Fonts, stock images, music, software and other third-party materials are licensed under their own terms, and we will tell you about any that need a licence in your name.
B4. Cancelling a project
You can cancel by emailing us at any time. We will refund any amount you have paid, including the deposit, less the value of the work done and any costs we have committed to at your request up to the date you cancel. There is no other cancellation charge.
B5. Our responsibility
We carry out the work with reasonable care and skill. For business clients, our total liability for a project is limited to the total fees paid for that project. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
8. If we cancel
If we have to cancel a project, we will refund everything you have paid for work we have not delivered.
9. Confidentiality and your information
We each keep the other’s confidential information private and use it only for the project. Our privacy notice explains how we handle personal information.
10. Complaints
If something is not right, please email admin@kamtobecreations.com. We will acknowledge your message within 5 working days and aim to resolve it fairly.
11. Law and courts
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and the mandatory consumer protections of the country where you live still apply to you.
12. Changes to these terms
We may update these terms from time to time. The version that applies to your project is the one in place when you confirmed your proposal.
